السلام عليكم.....
بصراحة كثر اللغط بخصوص المانيا والدخول اليها بفيزة شنغن غير مستخرجة من سفاراتها وخاصة للسعوديين... قرأت الكثير وجميع ما قيل صحيح بخصوص من ارجعوهم ولاكن توجد حلقة مفقودة هنا ولم يعرف السبب الحقيقي.
من جهة أخرى الكثير استطاع ان يدخل الى المانيا وبفيزة مستخرجة من دول اخرى....
وبين هذا وذاك جاء موظفوا الخطوط السعودية وبدأو يحذروا من هذه المسألة زادوها تعقيداً برفض اي مسافر لديه فيزا شنغن مستخرجة من غير المانيا.
كما ان موقع السفارة الألمانية الإليكتروني بالرياض بين وبصورة واضحة هذه المسألة وهو مسؤل عن كل ماينشر بهذا الموقع حسب تعبيره "ملاحظة: تتحمل السفارة الألمانية في الرياض مسؤولية ما يعرض على موقع السفارة الإلكتروني فقط" كاتالي:

حصلت على تأشيرتي من سفارة دولة أخرى عضو في مجموعة الشينغن، هل أستطيع السفر بها إلى ألمانيا؟
نعم، من يحصل على تأشيرة شينغن (مكتوب على لاصق التأشيرة "صالحة لدول الشينغن") بلغة البلد التي تم إصدار التأشيرة من سفارتها، أو الحاصلين على سمة إقامة أو بطاقة وطنية (فئة د) لأي دولة عضوة في الشينغن، يستطيع زيارة جميع منطقة الشينغن ومن ضمنها ألمانيا لمدة 3 أشهر في كل نصف سنة، طالما حدث ذلك في إطار مدة الإستخدام المسموحة.
إلا أنه يجب أن تصدر التأشيرة من سفارة البلد التي تعتبر وجهة السفر الرئيسية للزائر، ولا يعتبر بلد الوصول وبلد المغادرة مهماً في هذه الحالة.

ومع هذا ازددنا حيرة او بالأخص ازددت حيرة من أصدق واتبع ... السفارة ام الناس والأحداث الحقيقية التي حصلت...
فقمت بمراسلة السفير الألمانية برسالة عبر رسالة بريدية اليكترونية لمكتبه بالرياض وتم البث في الموضوع وهذا محتواها الاصلي ويشمل رسالتي اليه وهي :

DETERMINATION OF THE COMPETENT MEMBER STATE AND OF THE
COMPETENT CONSULATE OF THATMEMBER STATE
How to establish the competent Member State based on the applicant's travel destination
Legal basis: Visa Code, Article 5
2.1. Application for a uniform visa for a single entry
2.1.1. If the travel destination is one Member State, that Member State's consulate must
deal with the application.
2.1.2. If the travel destination includes more than one Member State, the application must
be dealt with by the consulate of the main destination. The main destination is
understood to be the destination where the applicant intends to spend the longest time
or where the main purpose of the intended journey is carried out.
Example: An Egyptian national wishes to travel for holiday purposes to Italy (for seven days)
and France (for four days) via Greece (no stay but stop-over at airport).
In this case the Italian consulate should deal with the application because Italy is the main
destination in terms of purpose and length of stay.
Example: A Moroccan national wishes to travel to Belgium for business reasons (two days)
and decides to visit relatives in France on the same occasion (six days). She will arrive at and
leave from Amsterdam (Netherlands).
The main purpose of the trip is the business appointment, and thus the Belgian consulate
should deal with the application.
Example: A Moroccan national wishes to travel to France for a family event (four days) and
has additionally organised a meeting with a business partner in Belgium (two days). He will
arrive at and leave from Amsterdam (Netherlands).
The main purpose of the trip is the family event, and thus the French consulate should deal
with the application.
Recommended best practice in case it is not possible to establish the main purpose of stay
among several purposes of stay: in such cases the length of stay should be used as the
criterion to determine which Member State is competent for examining and taking a decision
on the visa application.

2.1.3. If no main destination can be determined, the consulate of the Member State whose
external border the applicant intends to cross first must deal with the application
Example: A Ukrainian national is travelling by bus to Poland, Germany and Austria for the
purpose of tourism. She will spend four days in Poland, four days in Germany and three days
in Austria.
In this case the Polish consulate should deal with the application, as the visa holder crosses
the external border into Poland.
2.2. Application for a uniform visa for multiple entries
Recommended best practice for determining the Member State competent for dealing with
an application for a uniform visa for multiple entries: Generally an application for a multipleentry
visa should be dealt with by the Member State that constitutes the usual main
destination; i.e. the Member State of the most frequent destination or in the case of absence of
such a destination, the Member State of the first envisaged trip.
Example: A Senegalese national regularly visits her family in France but also travels to other
Member States for business purposes once or twice per year. The destination of her first
journey is Switzerland.
In this case the French consulate should deal with the application because it will be the most
frequent destination.
Example: A Ukrainian national working as a lorry driver for a Ukrainian transport company
regularly delivers goods to customers in Austria and has therefore been issued several
multiple-entry visas by Austria. The previous visa has expired and he applies for a new visa at
the Austrian consulate even though the company will now only deliver goods in Spain.
In this case the applicant should be referred to the Spanish consulate even if he is well known
at the Austrian consulate because his main destination will from now on be Spain.
